Our Commitment to Truth in Advertising

At Merrill & Associates Real Estate, we leverage cutting-edge technology to provide the most engaging and informative property tours possible. While we use Artificial Intelligence (AI) to enhance our marketing, we are committed to absolute transparency and accuracy regarding the physical condition of the homes we represent. Merrill & Associates strictly prohibits the use of AI to conceal material facts, structural defects, or adverse property conditions.

1. Use of Digital Persona’s/Avatars and Narration

Some videos on this website and in other communications utilize digital persona’s/avatars (created via HeyGen and other programs) to provide property details and narration.

Disclosure: These narrators are computer-generated representations and are not licensed real estate agents, employees of Merrill & Associates, or the property owners.

Purpose: We use these persona’s/avatars to provide you a myriad of information.

Supervision: All AI-generated persona/avatar scripts and narrations are reviewed by a human professional to ensure accuracy before publication.

2. Agent Photos

Some photos of agents themselves may be digitally enhanced or AI generated.

3. Digitally Altered Imagery (AB 723 Compliance)

Per California Assembly Bill 723, any marketing material that has been "digitally altered" must be clearly identified.

What is Digitally Altered: This may include but may not be limited to virtual staging (adding furniture), removal of personal items from a photo, and or digital rendering or modification of the floorpan.

What is NOT Digitally Altered: This may include but may not be limited to standard photo corrections (exposure, lighting, color correction, white balance, cropping, framing, resizing, straightening, angle adjustment and sharpening) that present an accurate view of the property are not considered "material alterations."

For every property featuring Digitally-Altered media, a link to the raw, unaltered source footage is provided directly on the property listing page or available upon request at [info@MerrillRE.com]."

4. Access to Original, Unaltered Media

As required by law, we maintain a repository of original, unedited footage for every listing photo to be considered Digitally Altered Imagery.

How to View: A direct link, URL, or QR code is provided on or adjacent to every altered video/image.

Requesting Originals: If a link is not visible, you may request the raw, unaltered footage for any listing by emailing [info@MerrillRE.com] with the property address and request for unaltered footage.

5. No Alteration of Property Condition

Merrill & Associates strictly prohibits the use of AI or editing software to:

Hide structural defects or property damage.

Alter permanent fixtures (flooring, walls, cabinets) without labeling it as a "conceptual render."

Misrepresent the surrounding neighborhood or views.

6. AI-Driven Communication & Texting Assistants

To provide immediate support and 24/7 availability, Merrill & Associates Real Estate may utilizes Automated Intelligent Assistants (AI Chatbots) for property inquiries and text message communications.

Our AI communication tools are programmed to identify themselves as automated assistants. They do not hold a California Department of Real Estate license and are not authorized to negotiate terms, provide valuations, or give professional real estate advice.

Non-Licensed Status: Our AI assistants (including SMS/Text responders) are not licensed real estate agents and are not authorized to provide legal advice, negotiate contracts, or offer professional opinions on property value.

Human Handoff: Our AI is designed to gather basic information and schedule appointments. If your inquiry requires a licensed professional, the AI will flag the conversation for a human member of our team to take over.
